Terms & Conditions

– Please read carefully

  1. Booking, Confirmation & Payment
    1. Tour & customised itinerary bookings are provisional until a non-refundable 10% deposit is received & confirmations issued, & until that time accommodation & services cannot be guaranteed.  The balance is due 45 days prior to arrival.
      • Vacation home rental bookings are provisional until a 50% deposit is received & a confirmation issued. The balance is due 3 months prior to arrival.
      • If payment is not received as scheduled, we reserve the right to treat the booking as cancelled by you & to levy cancellation charges as set out below.

      Please note that the Initial Deposit is only refundable if you cancel your booking within seven days of receiving our written confirmation of your booking.

    2. We will then send you a written confirmation of the booking so as to establish a binding contract between us.  The contract between you & us is governed by Irish law & we both agree that any dispute, matter or other issue which arises between us will be dealt with by the Courts of Ireland, wherever the services, matters or other issues in dispute are provided.
    3. The balance of the holiday must be paid not later than 45 days prior to arrival.
    4. A 3% booking fee will be added for all credit card bookings to cover handling costs (this charge is waived for bookings made through Travel Agents).
    5. Your Reservation – When you make a booking, we will propose a trip based on these terms & conditions. A binding contract between us will come into existence only when we have received your deposit (or if applicable full payment) & sent our confirmation to you.  We may send you an acknowledgement of receipt of the inquiry or reservation. Any such acknowledgement simply indicates that we are dealing with the booking & is not a confirmation of it.  Prior to our confirmation going out to you none of the accommodation or services can be guaranteed & all are subject to availability.
    6. We reserve the right to alter prices shown in any of our brochures or on our website or in any literature that we send to you & we will inform you of any price changes prior to the issue of our Confirmation Invoice. Once our Confirmation Invoice has been issued then, save in the case of manifest error, any price changes may only be made in accordance with the remaining provisions of these terms & conditions & we particularly draw your attention to the clause.
    7. Receipts – All deposit & balance payments will be acknowledged by email.
    8. Your booking is made as a consumer for the purpose of a holiday & you acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you.
  2. Alterations by you
    Any revision made after the original booking has been processed & deposit received will incur a €50 handling fee per booking per change.
  3. Cancellation by you
    1. Cancellations by you must be in writing to us & will be effective on the day we receive them. Recorded delivery is recommended but we will accept emails.
    2. (b) Cancellation charges will apply as follows, depending on when notification of cancellation is received:
      • Weeks prior to arrival Percentage of total
      • Up to 3 months prior to date of arrival – €200 administration charge
      • Between 8-12 weeks 20% plus €200 administration charge
      • Between 6-8 weeks 70%
      • Between 6-1weeks 80%
      • Less than 7 days 100%

      In all events the client will be refunded for any accommodation or services that are re-sold.

    3. We cannot give any allowance or refund for meals, accommodation, transport etc, not taken when these are included in the holiday price nor once the holiday has started can we give any refunds for cancelling part of the holiday.
  4. Alterations or Cancellation by us
    Once your booking has been confirmed we will make every effort to provide you with the booked holiday arrangements but reserve the right to alter or cancel the whole or part of the holiday if we cannot avoid doing so. Reasons for doing so would include such as extreme adverse local weather conditions, natural disasters, civil strikes or war, terrorist activity, fire, drought conditions & similar.

    We reserve the right to substitute hotels for accommodations in similar categories & to substitute visits, entertainment, & restaurants if those originally offered & confirmed are not able to provide the service. If any such alterations are significant then you will have the right to cancel the holiday when we will refund in full all monies paid as we will do in the event of cancellation by us.

  5. Our Responsibilities
    1. We accept liability to you in accordance with regulation 15 of the Package Holidays & Package Tours Regulations 1992 for the proper performance of our obligations under the contract irrespective of whether such obligations are to be performed by us or by other suppliers of services.
    2. Our statutory liability in this regard is subject to exceptions set out in the regulations. In summary they apply where failure to perform the contract or its improper performance is due neither to our fault nor that of anyone supplying services to us but is due or attributable to you, unforeseeable or unavoidable failures attributable to unconnected third parties, Force Majeure, or events which neither we nor our suppliers could, even with all due care, foresee. Even so if you suffer difficulties in any of these circumstances, we will do our best to give you prompt assistance within reasonable limits.
    3. Notwithstanding paragraphs (a) & (b) above our liability and/or the amount of compensation payable by us is limited in accordance with the relevant international conventions including the Warsaw, Geneva, Berne, Athens & Paris conventions. In addition, our maximum liability to pay you compensation for damage (other than personal injury) is limited to a full refund of the holiday price.
    4. Please note that we cannot accept any responsibility for weather conditions. Every effort will be made to ensure that you are not subject to inconvenience due to the above, but no responsibility can be accepted if this does occur.
    5. Every effort has been made to ensure that you have an enjoyable & memorable holiday. If however, you have any cause for complaint it is essential that you contact us as soon as any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we are promptly notified. Discussion of any criticisms with us whilst you are in residence will usually enable shortcomings to be rectified straightaway. Complaints of a transient nature (for example, regarding preparation or heating of accommodation) cannot possibly be investigated unless registered whilst you are in residence. Complaints not notified to us until after the completion of the holiday shall not be remedied. If any complaint cannot be resolved during your holiday, you must write to us with full details within 14 days of the end of it. Failure by you to complain at the earliest opportunity may prejudice your legal rights.
    6. We are not responsible for any loss, death or injury that is attributable to your acts or omissions, or the acts or omissions of third parties not involved in providing the services which make up your holiday, unless we could have foreseen such circumstances. Nor are we liable for unusual or unforeseen circumstances whose consequences could not have been avoided by exercising all due care. You are responsible for the conduct of any children travelling with you & for their compliance with the condition set out in section 7 of these conditions, & in particular those in section 7(b).
  6. Your Responsibilities
    1. It is your responsibility that passports (with at least 6 months validity) beyond the date of your return, visas, inoculation certificates & other necessary travel documents are in order & we reserve the right to charge you any costs incurred by us due to your failure in any of these respects.
    2. It is a condition of your contract with us that you act with reasonable prudence & circumspection whilst on holiday.
    3. As between you & suppliers of accommodation, transport & other services which form part of your holiday their conditions of business will apply which may mean that you will be required by such suppliers to sign liability waivers or other documentation for any potentially hazardous activities.
  7. In the case of rental properties: –
    You agree to comply with any regulations reasonably made from time to time by the owners / managers of the property that you are renting & ensure that they are observed by all members of your party.

    You agree to keep & leave the Property & the furnishings, kitchen equipment, crockery, glasses, bedding & towels clean & in good condition.

    You agree not to cause any damage to the walls, doors or windows of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties.

    You agree to take all necessary steps to safeguard your personal property. No liability to you is accepted in respect of damage to or loss of such property, except where the damage or loss is caused by our negligence.

    You agree to ensure that each member of your party is covered by comprehensive travel insurance (including cancellation, flight delays, loss & damage to baggage & other property) & health insurance (including evacuation & repatriation coverage).

    You cannot allow more people to stay in the Property than expressly authorised, nor can you significantly change the makeup of the party during your stay in the Property, nor can you take your pet into the Property unless it has been arranged in advance & it is shown on your confirmation, nor can you have more than twice the number of people who can sleep at the property staying at the property – in particular wedding receptions, concerts & other entertainments must be specifically noted on the conformation. If you do so, we can refuse to hand over the Property to you or can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you.

    You can arrive at your accommodation after 16:00 hours on the Arrival Date of your holiday & you must leave by 12:00 hours on the Departure Date.
    If your arrival will be delayed, you must contact the person whose details are given on our booking confirmation so that alternative arrangements can be made. If you fail to do so you may not be able to gain access to the Property. If you fail to arrive by midday on the day after the Arrival Date & you do not advise the contact of your anticipated late arrival we may treat the booking as having been cancelled by you.

    You agree to allow us or any representative of ours access at any reasonable time during your stay for the purpose of essential repairs.

  8. Car Rental Car rental companies in Ireland & Britain reserve the right to substitute cars for other models in similar category.
    Car Hire Insurance:

    1. Car rental insurance includes unlimited mileage, local taxes & third-party insurance, which includes passenger indemnity in respect to injuries resulting from an accident involving the rental car. The driver is not covered by this insurance but can purchase Driver & Baggage Protection (DBP/PAI) & or Optional Theft Protection (TP). This can be purchased at time of rental in Ireland or Britain.
    2. The hirer must leave an imprint of a major credit card with the car rental company at the start of the rental to cover any damage which may occur.
    3. The policy includes Collision Damage Waiver (CDW) subject to an excess. To insure against CDW deductible amounts, the hirer may purchase a Super CDW at start of hire.

    Age Limit: In Ireland drivers aged 23/24 years may drive groups B & E only & are subject to a young driver surcharge. In Britain & Northern Ireland persons aged 23-25 can drive groups A, B, C, D, E, F & I only & are subject to a surcharge. Maximum driving age in Ireland & Britain is 75 years. Drivers 76-79 years of age may rent but certain restrictions & surcharges apply – contact us for details.

    Driving Licence: Drivers must produce a current driving license issued in their state or country of residence without any endorsements & have a minimum driving experience of one year. Drivers whose licence is not in English must be in possession of an international driving permit.

    Extra Driver, One Way, Location Service, Drop Off, Out of Hours or Cross Border Charge: These supplementary charges are payable at start of hire directly to the car hire company.

  9. Insurance: You are strongly recommended to take out cancellation insurance, personal liability, baggage, personal accident & medical expense insurance cover.
  10. Privacy: We will keep your information on file (paper & electronic). In the future, you may receive periodic emails from us. Privacy is important to us; therefore, we will never rent, sell or give you personal contact details to anyone. Should you request us not to send any information we will delete your contact details after your holiday has been completed.
  11. Responsibility: Muse Ventures Ltd trading as Ireland and Britain Observered is not responsible for any personal injury, property damage or other loss a passenger incurs arising from acts or omissions by any public transport company, hotel, car rental company, subcontractor or other person or organization, whether or not such company is rendering any services supplied by Muse Ventures Ltd. All vouchers are issued & supplied subject to the foregoing & to any & all terms & conditions under which transportation & services are provided. Muse Ventures Ltd. Ltd reserves the right to decline to accept or to cancel or alter any booking. We accept no responsibility for losses or expenses due to delay or changes in schedules, flight cancellations or misconnections due to mechanical problems, sickness, quarantine, weather, acts of God, strikes, government actions, war, terrorism or other circumstances beyond its control. Passengers must bear all such losses or expenses. To guard against unforeseen circumstances, we recommend you purchase travel insurance.
  12. Claims or Disputes: You should inform Muse Ventures Ltd. Ltd immediately of any problems & prior to the end of the tour. Passenger contract with Muse Ventures Ltd. Ltd is subject exclusively to Irish Law & Jurisdiction.
